HomeMy WebLinkAboutChapter 30 - Article II - Establishment of Zoning DistrictsCity of Oshkosh Zoning Ordinance Municipal Code City of Oshkosh Chapter 30 – Article II -Page 1 Municipal Codes ARTICLE II: ESTABLISHMENT OF ZONING DISTRICTS Section 30-30: Purpose The area located within the jurisdiction of this Chapter is hereby divided into zoning districts of such number as is necessary to achieve compatibility of land uses within each district, to implement the City of Oshkosh Comprehensive Plan, and to achieve the other purposes of this Chapter. Section 30-31: Standard Zoning Districts For the purpose of this Chapter, all areas within the jurisdiction of this Chapter are hereby divided into the following standard zoning districts. See Article VI for overlay zoning districts and the Traditional Neighborhood Development Overlay District. Residential Zoning Districts SR-2 Single Family Residential – 2 SR-3 Single Family Residential – 3 SR-5 Single Family Residential – 5 SR-9 Single Family Residential – 9 DR-6 Duplex Residential – 6 TR-10 Two Family Residential – 10 MR-12 Multi-Family Residential – 12 MR-20 Multi-Family Residential – 20 MR-36 Multi-Family Residential – 36 MH-9 Mobile Home Residential – 9 Nonresidential Zoning Districts Agricultural RH-35 Rural Holding – 35 City of Oshkosh Zoning Ordinance Municipal Code City of Oshkosh Chapter 30 – Article II -Page 2 Municipal Codes Commercial I Institutional Use NMU Neighborhood Mixed Use SMU Suburban Mixed Use UMU Urban Mixed Use CMU Central Mixed Use RMU Riverfront Mixed Use Industrial CBP BP Corporate Business Park Business Park UI Urban Industrial HI Heavy Industrial Section 30-32: Map of Standard Zoning Districts Zoning districts established by this Chapter are shown on the Official Zoning Map of the City of Oshkosh, which together with all explanatory materials thereon, is hereby made part of this Chapter. Section 30-33: Interpretation of Zoning District Boundaries The following rules shall be used to determine the precise location of any zoning district boundary shown on the Official Zoning Map of the City of Oshkosh: (A) Zoning district boundaries shown as following or approximately following the limits of any city, town, or county boundary shall be construed as following such limits. (B) Zoning district boundaries shown as following or approximately following streets or railroad lines shall be construed as following the centerline of such streets or railroad lines. (C) Zoning district boundary lines shown as following or approximately following platted lot lines or other property lines as shown on the City of Oshkosh or Winnebago County tax maps shall be construed as following such lines. City of Oshkosh Zoning Ordinance Municipal Code City of Oshkosh Chapter 30 – Article II -Page 3 Municipal Codes (D) Zoning district boundaries shown as following or approximately following the centerlines of streams, rivers, or other continuously flowing watercourses shall be construed as following the channel centerlines of such watercourses, and, in the event of a natural change in the location of such streams, rivers, or other watercourses, the zoning district boundary shall be construed as moving with the channel centerline. (E) Zoning district boundaries shown as following or approximately following ridgelines or watershed boundaries shall be construed as following such lines. (F) Zoning district boundaries shown as separated from, any of the features listed in paragraphs (A) through (E), above, shall be construed to be at such distances there from as are shown on the Official Zoning Map. (G) Where any uncertainty exists as to the exact location of a zoning district boundary line, as shown on the Official Zoning Map, the location of the line shall be determined by the Director of Community Development, or designee. Section 30-34: Description and Purpose of Zoning Districts The following Sections specify the description and purpose of the standard zoning districts established by this Chapter, establish principal and accessory uses permitted by right or as conditional uses, establish bulk, density, and intensity standards, and reference other applicable regulations. Definitions and regulations for land uses are provided in Article III. Section 30-74 includes a Table of Land Uses indicating which land uses are allowed in each zoning district, and whether they are permitted by right, by conditional use, as accessory uses, or as temporary uses. This district intended to permit very low density single family detached residential development at a density of no more than one dwelling unit for every 35 gross acres. This district acts as a “holding zone” to preserve productive agricultural lands in the long-term, protect existing farm operations from encroachment by incompatible uses, promote further investments in farming, and may maintain eligibility for farming incentive programs. (I) Principal Uses Permitted by Right. Refer to Article III for detailed definitions and requirements for each of the following land uses. The new lot may include the existing residence, allowing the rest of the undeveloped original lot to be sold. The required maximum residential density of one dwelling per 35 acres is intended to retain agricultural or other rural uses until urban services are available to enable a zoning map amendment to a development-oriented zoning district. This district intended to preserve and enhance existing areas of very low density single family detached dwellings. Unlike the case for the (RH-35) Rural Holding District, the land use standards for this district permit primarily single- family detached residential development at an approximate density of 2 dwelling units per acre and a variety of related institutional land uses, and are not oriented to a wide range of agricultural activities. (B) Principal Uses Permitted by Right. Refer to Article III for detailed definitions and requirements for each of the following land uses. (F) Exterior Materials. Commercial buildings shall be clad on all sides with at least 75 percent Class I materials. Class II and Class III materials may be used as accents and trim not to exceed 25 percent of the total building façade. Class IV materials are prohibited. (1) Materials of comparable quality may be substituted for any class of material or be used as a decorative element if the material can be removed or replaced with a permitted exterior material, as determined by the Director of Community Development, or designee. (G) Building composition. (1) General design. All buildings shall be designed with four-sided detail, have a distinct base, middle and top. The base of the building shall be articulated with a horizontal expression line creating a distinct ground level zone of the building. The middle, or mid-section, of the building shall be articulated by surface variations of depth through windows and architectural elements and City of Oshkosh Zoning Ordinance Municipal Code City of Oshkosh Chapter 30 – Article II -Page 77 Municipal Codes form an expression line which sets up the building's top. The top portion of the building shall include architectural features of form that provide distinction and clearly shows a division of roof and walls. In addition to the required windows and principal entrance, the front facade shall include architectural features which emphasize it as the front facade. Building components and appurtenances, including doors, windows, canopies and trim should maintain a harmonious proportion to each other and to the building as a whole. (H) Door and/or Window Openings. Windows and doors or other openings at ground floor level shall comprise at least 40% of the area of the street facing façade. (I) Façade Articulation. (1) Façade lengths shall not be greater than 40 feet without articulation such as: (a) Division of the façade into individual components (i.e., storefronts, distinct uses) through the use of architectural elements such as porches, balconies, windows, covered entrances, arcades, awnings, marquees, lighting, signage, etc. (b) Recesses or projections that step back or project a portion of the main façade plane. (c) Recesses or projections of upper floors from the ground floor façade plane. (d) Vertical division using different textures or materials. (e) Roof form variation such as the inclusion of dormers, change in roof lines, or change in roof type. (J) Accessory Structures. Materials used to construct accessory structures such as trash enclosures and signage shall include materials and colors that are consistent with the principal building. (K) Parking (1) A maximum of 25% of the required onsite parking shall be located between an arterial street and the principal building. (L) Landscaping in the setback area between the street frontage and the principal building shall include large contiguous planting areas along the entire street frontage and include a mix of deciduous trees, shrubs, and native plantings. 50% of the Yard Landscape Points as required per Section 30-253 Landscaping Requirements shall be placed along the street frontage.
