ARTICLE XII: OFFICIAL MAP
SECTION 30-440: OFFICIAL MAP
A) Purpose and Scope. To conserve and promote public health, safety, convenience,
and general welfare, there is hereby established an Official Map of the City and its
extraterritorial plat jurisdiction, said map consisting of the attached maps of the City
marked Exhibits "l-26" inclusive, and the maps pertaining to Highway 4l access
roads heretofore adopted by the Common Council of the City on the 7th day of
March, l962 and the l7th day of October, l962.
B) Filing. Immediately upon this Article becoming effective, the City Clerk shall file a
certificate with the Register of Deeds for Winnebago County showing that the City
has adopted such Official Map.
C) Effect. Such Official Map shall be deemed to be final and conclusive with respect to
the location and width of streets, highways and parkways, and the location and
extent of parks and playgrounds shown thereon.
D) Changes and Additions. The Common Council, whenever and as often as it may
deem it for the public interest, may change or add to the Official Map so as to
establish the exterior lines of planned new streets, highways, parkways, parks or
playgrounds, or to widen, narrow, extend or close existing streets, highways,
parkways, parks or playgrounds. Any such change or addition may be made only
in the manner prescribed in Section 62.23(6)(b) of the Wisconsin Statutes.
E) Subdivision Plat Recommendations. The City Plan Commission shall require
conformity with the Official Map in recommending approval of any subdivision
plat.
F) Building Permits. For the purpose of preserving the integrity of such Official Map,
no permit shall hereafter be issued for any structure that does not provide the
setback set forth in this Chapter from any street, highway or parkway shown or laid
out on such map, and no permit for the erection of any structure shall be issued
unless a street, highway or parkway giving access to such proposed

structure has been duly placed on such map, except as provided in paragraphs (d)
and (g) of Section 62.23(6) of the Wisconsin Statutes. The proper official authorized
to issue building permits may require each applicant to submit a plot plan, certified
by a registered surveyor, showing accurately the location of any proposed structure
with reference to any street, highway or parkway shown on the Official Map.
